TERMS AND CONDITIONS

In these terms “us”, “our” and “we” refer to Westcountry Machinery4 Wood.  You can write to us at Beacon Kilns, High Street Village, St Austell, Cornwall, PL26 7SR. We are available via e-mail at sales@machinery4wood.co.uk. “You”, “your” and “yourself” refer to the customer/business that places an order with us. The “recipient” refers to the person/business to which the goods/services are delivered. Please direct any complaints to the above address.

A contract comes into force once your order has been delivered by us. Acceptance of delivery or collection by you of the goods will be deemed your acceptance of these conditions. The contract is governed by the Terms and conditions as set out here. We reserve the right not to accept / cancel / refuse any order even after payment has been made.

We make every effort to ensure that our prices and descriptions are accurate at the time of going to press for all marketing purposes (including the website). We offer this material as a guide only and it does not necessarily represent the goods on offer. We or our suppliers cannot be held liable under the Trade Descriptions Act 1968 for any inaccuracies of pricing, definition, colour or images. Due to continuous improvements, we reserve the right to change descriptions and pricing without prior notice.

In the event of an error or if the manufacturers prices or specifications changing we will offer you the option to cancel your order or reconfirm with the adjustments included. All tools and machinery are supplied in accordance with UK safety regulations. This may conflict with images on our website which could be non-UK models however, this does not affect the safe operation of the equipment supplied. We are under no obligation to provide goods to you at the lower (incorrect) price if the pricing error is obvious and could reasonably be recognised by you as an error. VAT, where included in the price, is charged at 20%. We reserve the right to alter this amount, without notice, in line with the current government legislation.

We will endeavour to deliver your goods as soon as reasonably practical. Please note that any dates quoted by us for delivery are estimates only. We shall not be held liable to you in respect of any consequential costs, expenses or losses suffered by you in regard to any expedition, or delay, in delivery. If we are unable to deliver your goods within 30 days of your order, you may cancel your order for a full refund.

We will require payment in full from you before we dispatch the goods to the recipient, unless we have agreed in writing with you otherwise. Account holders with us are, at our discretion, allowed to make payment in full to the terms of their account.

When you, or on behalf of yourself, the recipient receives the goods, you should check them for quality and condition immediately and in the presence of the courier. If in any case you or the recipient finds the goods to be of an unsatisfactory condition, you will endorse the courier’s documentation to that effect. Please let us know within 24-hours of receipt if there are any problems with the delivery.

As a B2C customer you may cancel the order for a full refund at any time from when the order is placed up until 14-working days after the day on which you, or the recipient, receives the goods. We define a working day as any day other than weekends and public holidays. If you wish to cancel the order, we require that you do so in writing to us at the address, or e-mail address, given in part 1 of these conditions, within 14-working days, as stated above. We ask that the goods be returned with the original packaging in a resalable, re-sellable condition. You must return the goods at your own cost to us at the address given in part 1 of these conditions. It is your statutory duty to ensure that you take reasonable care of the goods until they are returned to us. In the case of deterioration of the goods value replacement will be demanded. If you do not return the goods to us, we may claim against you for breach of your statutory duty and the cost of recovering the goods ourselves. This does not apply if they are returned to us in a state where the deterioration of the goods can be ascribed to inspection thereof – as would have been possible in a retail establishment. On receipt of your cancellation a full refund will be given within 30-days. We operate B2B and B2C trading terms, if you are a B2B customer please ask for those trading terms.

Subject to the above, we may at our sole discretion accept the return of any goods, provided the customer provides proof of purchase for the goods to be returned. A handling charge of up to 15% may be made to cover the cost of restocking the goods, in addition to this we reserve the right to apply a carriage charge to cover the cost of the outward, and if required, inward deliveries. Any item that is not a current stock item is considered a special order; we also reserve the right to impose a further charge for which the customer is liable, to cover the cost of cancellation or return of special orders.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

 

MANUFACTURERS DECLARATION OF WARRANTY

Notwithstanding statutory requirements our manufacturers provide warranty in accordance with the legislation of the suppliers own country of residence, but in all cases for a minimum of 1 year commencing from the date on which the tool/machine is sold to the end user. If the end user takes the item(s) out of the country of purchase then the item must be returned to the supplier for warranty to be carried out and collected from the supplier after the warranty repair has been completed.
The warranty covers defects in material and/or workmanship only.
When making a claim under the warranty, the original proof of purchase bearing the date of purchase must be submitted.


DELIVERY AND RETURNS


Payment

We have a very secure online ordering facility, we accept ALL major debit and credit cards and Paypal. You must enter exact billing details for your transaction to be successful - this is the information that your bank has on their records of where the payment method is registered. Incorrect house numbers, postcodes etc will lead to a transaction payment failure.


Delivery

We aim to deliver all products as soon as possible and we endeavour to notify you of any delays.

For selected products under 1kg in weight & under £100 in value we charge £4.95 for delivery, most other products we charge from £7.95 for mainland UK delivery.

Offshore, Scotland, Ireland price start from £12.95 as standard but may vary dependent on the product & your exact location

For heavy machinery and orders which require a palletised delivery; orders will be sent via courier at a rate from £29.99 (mainland UK) Please Note: this will be a kerbside delivery only & will take between 1-5 Working days, however this can be longer during busy periods & bank holidays.

 

Failed Deliveries

It is your responsibility to monitor your delivery with the tracking numbers supplied at the point of despatch and that you provide correct email and mobile numbers to ensure the information passes to you securely. You must also ensure that delivery companies have all of the correct information possible to complete your delivery successfully. If a delivery company cannot make a delivery to you for whatever reason, or if you refuse to accept a delivery and returns your delivery to us, we reserve the right to pass the return costs of that delivery, charged to us by the delivery company, on to you by way off an additional charge or by deduction from any refund. It is not recommended that you leave a note on a door or window as delivery drivers are instructed to ignore any instructions other than that which we provide on your behalf, ie safe place, with neighbour etc.


Some carriage charges will need alteration after order and we will contact you to discuss this.

All delivery charges are subject to change depending on location and circumstances.

The order will not be confirmed until we accept payment. If there is an adjustment to delivery you will be notified to confirm the adjustment before your order is processed.


Returns & Refunds

For all returns and refunds please contact us via email or telephone.

Our returns policy is governed by our terms and conditions, please refer to our terms for information about our returns schedule. If you require an item to be returned, please first contact us via the above method quoting your order number, product code & description, price paid and when you purchased the product.  Orders returned to us in full within 14-days of purchase will be refunded.  We reserve the right to deduct a 15% re-stocking charge where necessary, excluding your original postage cost, and this will also exclude your return postage. After this 14 day period we reserve the right to refuse acceptance of returned goods. We also reserve the right to pass on payment processing fees charged to us by your payment provider for cancellations or returns - ie Paypal refunds will attract a 1.9% refund fee + 60p, all other uk card payments 1.25%


Returns & Refunds Procedures

If you are returning a product to us, please safely package your goods up & return to the below address marking for the attention of the returns department. Please include a copy of your original invoice, or a note with your full name, order number, address & contact telephone number & the required action (refund / replace). Once received the items will be checked & a refund/replacement will be actioned. It is your interest to make sure the item is fully covered against finacial loss during the return transit process, if you chose not to have sufficient cover on the goods then this is your responsibility in the event of loss or damage.

DAMAGED IN TRANSIT/MISSING ITEMS

Any deliveries that arrive damaged are FULLY covered however, you will need to report the damage to us either via email or telephone within 24 hours of receiving your order to have the best chance of successful claim. There are no exceptions to this as any claims arising from delivery damage are to be reported to the respective courier company within 48 hours, we cannot guarantee a couriers liability outside of this time frame.  If the packaging is damaged & you suspect the goods are likely to be damaged/missing, please sign for the delivery as damaged & report the damage to us immediately.  Any damages or missing items not reported within 24 hours may not be covered - this does not affect your statutory rights & any product that develops a manufacturing fault will be covered in accordance with the manufactures warranty. In the event of any notifications received 7 days or more after delivery then it is deemed to have been sufficient time to inspect goods and report any issues and as such any claims will not accepted.


SECURITY

We have never had a report of fraudulent credit/debit card use as a result of using our site. We take great care to ensure that your information remains confidential once you have entrusted us with it. We do not have access to or retain any of your payment information, this is a secure transaction between you and your payment provider. All card information is encrypted using industry-leading technology that implements Secure Socket Layering (SSL) to protect your data as it is transferred to us. This same standard ensures millions of secure eCommerce transactions every day. All your information is held in the strictest confidence in line with our Privacy Policy.
